Marc A. Hubbard

Marc Hubbard holds engineering and law degrees and has over thirty-five years of experience in a wide range of intellectual property legal matters.

Admitted to the State Bar of Texas and registered with the United States Patent and Trademark Office since the late 1980s, Marc represents entrepreneurs, startups, and established technology businesses in securing and enforcing intellectual property rights.

His practice currently focuses on:

  • Advising clients on patent, trademark, copyright, and trade secret protection strategies.

  • Writing and prosecuting patent applications before the USPTO in a wide range of technical fields, including electrical, telecommunications, software, data security, mechanical, downhole tools, materials, and consumer products.

  • Overseeing patenting and trademark registration in other countries, and managing global patent and trademark portfolios.

  • Counseling clients on the validity and infringement of patents and trademarks; designing around IP rights; reverse engineering; providing legal opinions on patent validity and infringement; and conducting clearance and freedom-to-operate searches and reviews.

  • Drafting and negotiating consulting, development, licensing, assignment, and services agreements involving intellectual property rights, including cross-licensing.

  • Counseling and representation on IP issues in a wide range of business transactions, bankruptcies, and other matters.

Marc has also served as a testifying expert witness on USPTO procedures in patent infringement cases.

Marc has taught patent prosecution at the SMU Dedman School of Law in Dallas as an adjunct clinical professor of law; planned and chaired continuing legal education programs; lectured at legal education meetings; and participated in pro bono educational programs for the public. He has served as member of the Board of Directors of the American Intellectual Property Law Association (AIPLA), the chair of the IP section of the Dallas Bar Association, the chair of the Patent Law Committee of the AIPLA, the co-chair of the Patentable Subject Matter Task Force of AIPLA. He is currently a member of the Barbara M.G. Lynn American Inn of Court in Dallas, and a member and fellow of the Dallas Bar Association, the Texas Bar Foundation, and AIPLA.

His recognitions include the AIPLA Project Award for guiding the work of the AIPLA’s Patentable Subject Matter Task Force; the Dallas Bar Association’s Outstanding Section Award for his leadership of the Dallas Bar Association IP section; “Texas Super Lawyer” by Thompson Reuters; and D Magazine’s Best Lawyers in Dallas. Before starting Hubbard Law, Marc was a partner in the intellectual property sections of several large general practice firms in Dallas, Texas.
